ORAL ORDER
After arguing the matter for some time, learned counsel for the petitioner submits that the petition may be disposed of reserving liberty in favour of petitioner to file objections in the pending Criminal Miscellaneous No.36/2024 and direct the learned Magistrate to dispose of the proceedings in accordance with law after affording sufficient and reasonable opportunity to all parties.
2. Under these circumstances, though several
contentions have been urged by both sides in support of their respective claims, without expressing any opinion on the

merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition directing the Trial Court to dispose of the said Criminal Miscellaneous No.36/2024 on merits and in accordance with law, by giving sufficient and reasonable opportunity to all parties. All rival contentions on all aspects of the matter are kept open and no opinion is expressed on the same.
3. Liberty is reserved to file objections and contest the proceedings.
4. Subject to the aforesaid observations and directions, the petition stands disposed of.
