The present writ petition has been filed with the following prayers :- “(I) Issue a writ, order or direction in the nature of certiorari to quash the recovery citation dated 31-10-2023 issued by the Tehsildar Bajpur, Udham Singh Nagar, (Annexure No.05) to the writ petition. (II) Issue any other order or direction which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. (III) Award the cost of the petition to the petitioner.” 2. Heard Mr. Mohd. Matlub, learned counsel for the petitioner and Mr. Devendra Singh Bohra, learned Standing Counsel for the respondents. 3. Mr. Mohd. Matlub, Advocate, has requested to 2025:UHC:717 2 permit the petitioner to withdraw the present writ petition granting liberty to file an appeal before the Commissioner under Section 15 of the Uttarakhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2021. 4. The said submission has not been opposed by the respondents. 5.
