The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act. 3. As per F.I.R., 69.24 liters of illicit foreign liquor has been recovered from cow-dung cake house of this petitioner, which is an open place. 4. It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of petitioner and recovery has been effected from an open place. 5.
