Instant FAM has been filed by the appellant/husband against the judgment and decree passed by the 1st Upper District Judge, Bastar at Jagdalpur in Civil Suit No. 27-A/2006, whereby the application filed by the appellant under Section 13 of the Hindu Marriage Act, 1955 for decree of divorce, has been dismissed. Learned counsel for the appellant/husband would submit that, after passing of the impugned judgment and decree, settlement has arrived at between both the parties and they are residing together with love and affection, therefore, the appellant does not want to prosecute this appeal any more, hence, he may be permitted to withdraw this appeal. 4. Learned counsel for the respondent/wife also conceded aforesaid fact. 5. On due consideration, the appellant is permitted to withdraw this appeal, as both the parties are residing together peacefully. Hence, this appeal is dismissed as withdrawn. 6.
