The instant writ petition has been preferred by the petitioner in an independent capacity on behalf of the original mining lease holder. 2. Learned counsel for the petitioner submits that since the petitioner is holding power of attorney to act on behalf of the mining lease holder, hence in an independent capacity, the instant writ petition has been preferred. 3. In the considered opinion of this Court, power of attorney holder cannot file independent writ petition in his own name. He can file the writ petition on behalf of the original litigant through power of attorney. 4. On this count alone, the writ petition is liable to be and is hereby rejected. Stay application as well as all applications (pending, if any) also stand rejected. However, the original lease holder would be at liberty to file fresh writ petition through power of attorney.
