JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 16.06.2025 Heard Mr. B.M Deka, learned counsel for the petitioner Dipjyoti Gogoi who has filed this application under Section 483 of the B.N.S.S, 2023 with prayer for bail as he is behind bars since 28.05.2025 in connection with Noonmati P.S Case No. 83/2025 under Section 69/351(3) of the B.N.S, 2023. It is submitted on behalf of the petitioner that this is a case of honey trapping and the petitioner has been falsely implicated in this case. I have considered the submissions at the bar with circumspection. The allegation against the petitioner is that he concealed the fact that he is married and then he got married to the victim. Now, the victim is 3(three) months pregnant. The victim has learned on 14.04.2025 that the petitioner is a married man and is currently residing in Sivasagar. When the victim called the petitioner, the petitioner threatened the victim with dire consequences. I have scrutinized the Case Diary. Investigation has progressed substantially. I have considered the submission that the petitioner is willing to co-operate with the remaining part of the investigation and to abide by any bail conditions, if imposed upon him. It appears that custodial detention may not be required to further the investigation. Considering all aspects, this petition is allowed. The petitioner is enlarged on bail of Rs 30,000/- with a suitable surety of like amount to the satisfaction of the Chief Judicial Magistrate, Kamrup (M) under the conditions that : (1) The petitioner shall not jump the bail and co-operate with the investigation. (2) The petitioner shall not exercise threat to the witnesses or to the victim.
