HIGH COURT OF TRIPURA AGARTALA Cont.Cas(C) 93 of 2024 Benu Ranjan Goswami ---Petitioner(s) Versus Sri Apurba Roy and Others ---Respondent(s) For Appellant(s) : Mr. P Roy Barman, Sr. Advocate. Mr. K. Chakrborty, Advocate. For Respondent(s) : Mr. Dipankar Sarma, Addl. GA. HON’BLE MR. JUSTICE T. AMARNATH GOUD Order 06.01.2025 It is represented by the learned Addl. GA for the respondents that during the pendency of the instant contempt proceeding, the respondents have already complied with the order dated 29.01.2024 passed by this Court. It is further submitted that the respondents have almost completed the formalities and a final correspondence would be made to the petitioner hopefully within a period of two weeks. [2] On the other hand, Mr. P Roy Barman, learned senior counsel for the petitioner has submitted before this court that since no communication with regard to the proceeding has been made to the petitioner, the petitioner has once again approached before this court for seeking relief. It is further submitted that the respondents be directed to comply with the order dated 29.01.2024 as early as possible and communicate the outcome of such compliance at the earliest. [3] Considering the submission as advanced by the counsel for the parties, this court is of the opinion that deciding the matter is now out of contempt jurisdiction and therefore, this court has no hesitation to close the contempt case. Accordingly, it stands closed. However, there shall be a direction upon the respondents to conclude the proceeding in pursuance to the order dated 29.01.2024 passed by this Court and issue a speaking order to the petitioner on or before 01.02.2025. [4] It is needless to mention here that if the petitioner is aggrieved by such communication that would be so provided by the respondents, the petitioner will be at liberty to approach before the appropriate forum for seeking relief. [5] With the above observation, the instant contempt case stands closed and disposed of. JUDGE Dipak DIPAK DAS Digitally signed by DIPAK DAS Date: 2025.01.07 14:15:08 +05'30'
