And 4 Others Counsel for Petitioner :- Shyam Mohan Upadhyay Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1.Vakalatnama filed today by Shri Mohiuddin Khan, Advocate on behalf of respondent No.5 is taken on record. 2. Heard. 3. Petitioner a senior citizen alleges interference in her possession of certain land on which she wants to construct a house etc. The interference is alleged by respondent No.4- Station House Officer, Police Station Bhagwati Ganj, District- Balrampur and respondent No.5, Shri Kirti Shekhar a private person. Learned Counsel for the respondent No.5 says that a civil suit had been filed by certain persons against the respondent No.5 and others seeking declaration, eviction and possession etc., wherein a compromise was arrived at and the petitioner had filed an application for restoration of the said proceedings, which has been rejected. Counsel for the petitioner feigns ignorance. Without going into this issue as the Standing Counsel for the State says that the police is not interfering the matter at all and the FIR lodged by the petitioner against the persons from whom he had purchased the land is under investigation. The petitioner may avail other remedies as essentially the dispute appears to be a private one. 4. With the aforesaid observations, the writ petition is disposed of. (Om Prakash Shukla, J.)
