1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. These application for grant of anticipatory bail arises out of Bhairavsthan Police Station Case No. 126 of 2024
Patna High Court CR. MISC. No.6887 of 2025(2) dt.21-03-2025 2/3 dated 11.12.2024, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.

The prosecution case, as per the First Information Report, is that the police, on secret information that illicit liquor was being manufactured and sold in village- Raiyam, reached at the place of occurrence and on seeing the police, one person trying to flee away but was apprehended and identified as Somit Paswan. On search, the police recovered 08 litres and 26 liters respectively of illicit country-made chulai liquor and other materials used for preparation of liquor from the thatched houses of the petitioners.

Learned Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case on the disclosure of their names by the local residents. He further submits that the petitioners have got no concern with the illicit liquor recovered and/or the materials used for manufacturing liquor inasmuch as the illicit liquor and other incriminating articles were recovered from the thatched houses, accessible to all and sundry. He further submits that the petitioners have got no criminal antecedent.
5. Regards being had to the submission advanced on behalf of the parties concerned and taking into consideration the
Patna High Court CR. MISC. No.6887 of 2025(2) dt.21-03-2025 3/3 fact that the petitioners were involved in the manufacturing of spurious liquor, consumption of which may be injurious to the health of general public, I am not inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, dismissed.
