( 2025:JHHC:16529 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 5020 of 2025 ------ Md. Rehan @ Rehan Baccha @ Lalwa, aged about 21 years, s/o Ranjit @ Md. Shahid, r/o Carriage Colony, Muslim Basti, P.O. & P.S.-Burmamines, Town-Jamshedpur, Dist.-East Singhbhum (Jharkhand) … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Anurag Kashyap, Advocate For the State : Mr. Shailesh Kr. Sinha, Addl. P.P. ------ Order No.02 Dated- 23.06.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Burmamines P.S. Case No.61 of 2024 (G.R. Case No. 390 of 2025) registered for the offences punishable under sections 126(2)/115/118(1)/109/308(3)/351(2) of the B.N.S., 2023. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner attempted to murder the husband of the informant upon the refusal of the husband of the informant to give in, to the demand of extortion. It is further submitted that the allegations against the petitioner are all false. It is then submitted that the petitioner has been in custody since 19.12.2024, as has been mentioned in paragraph no. 13 of the bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the petitioner is a hardened criminal and he is involved in two other cases including one case of attempt to murder. It is next submitted by learned Addl. P.P. that the petitioner is a threat to the law-and-order situation in the locality therefore, there is every chance of the petitioner absconding and tampering with evidence, if released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail. Considering the serious nature of allegation against the petitioner, his criminal antecedent as well as the chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail. Accordingly, the prayer for bail of the abovenamed petitioner is rejected. (Anil Kumar Choudhary, J.) Sonu-Gunjan/
