Heard the parties.
2. The petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No. 95/2024, for the offences registered under Sections 319(2), 318(4), 338, 336(3) & 340(2) of the B.N.S. 2023 and Section 66(B), 66(C), 66(D) & 84(C) of the I.T. Act, pending in the Court of learned Additional Sessions Judge-II-cum-Special (Judge), Cyber Crime, Deoghar.
3. Bail application of the petitioner was earlier permitted to be withdrawn vide B.A. No. 9269/2024 by order dated 29.01.2025.
4. On 14.09.2024, cyber police Deoghar, on the basis of confidential information that cyber criminals had assembled near Pathalchatti, raided the place of occurrence and apprehended this petitioner. On search, a mobile phone was recovered from the possession of the petitioner.
5. It appears that one witness has turned up to claim that the mobile phone which was used in cheating, was recovered from possession of the petitioner.
6. It was submitted that the petitioner has remained in custody for about eleven months.
7. Considering the period of custody, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special (Judge), Cyber Crime, Deoghar in connection with Deoghar (Cyber) P.S. Case No. 95/2024.
