Hon'ble Om Prakash Shukla,J. Heard. Father of the newly substituted petitioners had applied for allotment of an H.I.G. House in a scheme of the U.P. Avas Evam Vikar Parishad, however, on instructions from the Authorities of the Parishad, as informed Sri Puneet Chandra, the said scheme underwent a change and consequent to the change, allotment of house was to be made under self-finance scheme Accordingly the petitioners' father was asked to take back the money deposited by him, as the house could not be provided to him, however, the case of the petitioners is that others placed similarly to the petitioners have been provided flats elsewhere, therefore, they pray that their case may also be considered accordingly. Sri Puneet Chandra, Advocate, further says that only those who had applied for such allotment of flat, have been given the said benefit. Be that as it may, an application has been submitted by the petitioners in this connection to the Commissioner, Avas Evam Vikas Parishad, therefore, the said application be considered as per Rules and a decision be taken accordingly after getting the facts verified, but expeditiously, say within 2 months. It is open for the petitioners to move a fresh representation, which shall be considered and decided in the above terms. With the above observations, this writ petition is disposed of.
