The present petition has been filed with the following prayer : (i). to pass the order or direction to the learned court below to decide the interim stay application (5G2), in Regular suit No. 1178/2023 (Badka Versus Rohit Kumar & Others), which is pending before learned Civil Judge (Senior Division) Room No 15, Sultanpur, since 29.11.2023, according to law within time stipulated by this Hon'ble Court. (ii). to pass the order or direction to the learned court below to decide the application under section 151 C.P.C. and Regular suit No. 1178/2023 (Badka Versus Rohit Kumar & Others). pending before learned Civil Judge (Senior Division) Room No. 15, Sultanpur, since 29.11.2023, according to law within me stipulated by this Hon'ble Court. 3. Considering the prayer limited to the issue of mandamus, the writ petition is disposed off directing the court below to decide the interim stay application (5G2) and also the application under section 151 CPC pending in Regular suit No.1178/2023 (Badka Versus Rohit Kumar & Others), expeditiously within a period of six weeks from the date of production of a certified copy of this order.
