ORAL ORDER The present writ petition is filed questioning the order passed in I.A.Nos.8 and 11 dated 26.11.2024 in M.C.6236/2021 by the I Addl. Principal Judge, Family Court, Bengaluru whereby the Family Court had partly allowed I.A.No.11 and father was permitted to visit the minor child on first and third Saturday after her school hours at the Child Visitation Centre, Family Court, Bengaluru till 6.00 pm., and had dismissed I.A.No.8 which was filed seeking for enhanced visitation.

Learned counsel appearing for the petitioner/father submits that the parties were residing together till the year 2022 and the father is sharing a good bonding with the daughter, the daughter is 11 years old and granting the visitation in the Child Visitation Center that too for such a short period will come in the way of the father and the child’s bonding and the time that is granted is not sufficient.

Learned counsel appearing for the respondent/ mother submits that the father is not taking care of the responsibilities of the child, but he is only agitating for his

rights and several contentions were raised on the last occasion. On 25.04.2025, this court had passed the order and the operative portion of the order is as follows:
“i. The father is permitted to have the visitation on 26.04.2025, Saturday and on 27.04.2025 from 11:00 a.m. to 6:00 p.m. The mother shall hand over the custody at 11:00 a.m. and shall pick up the child at 6:00 p.m. ii. Out of an amount of Rs.4,00,000/-, an amount of Rs.1,00,000/- shall be paid on 27.04.2025 and from there, in next 30 days another amount of Rs.1,00,000/- and like that remaining amount of Rs.2,00,000/- shall be paid.”

Today when the matter came up, it is submitted by the father that as per the order passed by this Court, the visitation went on very well and also he has handed over a cheque for an amount of Rs.1,00,000/- and he submits that within one month from today, again he will be paying the other Rs.1,00,000/-. Likewise he will pay an amount of Rs.4,00,000/- . It is submitted that considering the ensuing holidays and how the visitation went on as per the order passed by the Court, further orders may be passed granting visitation to the father.

Learned counsel appearing for the respondent/ mother submits that the daughter has extracurricular activities and if more time is granted as the girl is not having any friends in the said locality will get bored. It is submitted that the court may not extend the time on 1st, 2nd and 21st to 28th of May, 2025, the mother and the child are not in Bangalore and on those days the visitation may not be granted.

Considering the fact that the father is ready to pay the educational expenses and he has already paid an amount of Rs.1,00,000/- and also ready to pay the other amount and also as per the earlier order the visitation went on very well as per the submission of the father. This Court deems it appropriate to pass the following
ORDER i. The father can excise the visitation on 3rd, 4th, 6th, 7th, 10th, 11th, 14th, 17th, 18th, 20th, 31st of May and 1st, 4th, 7th and 8th June, 2025. ii. The mother shall drop the child at 11 a.m. to the father’s place and the father shall drop the child back to the mother’s place at 6.00 p.m.

iii. After the school reopens, the father can exercise the visitation on every Saturday between 11.00 am. and 6.00 pm. with the same arrangement. iv. On any of the days when the girl is with the father and if there are any extra curricular activities to be attended by the girl, the father shall accompany the girl. v. As this Court has already made sufficient arrangements which will help the father to develop the bonding, this arrangement shall continue till the winter vacation. Before the winter vacation, the father or the mother is at liberty to come up with an application if necessary and basing on what has transpired the Family Court can pass appropriate orders on such application. vi. Accordingly, the writ petition is disposed of. vii. All I.As., in the writ petition shall stand closed.
