The petitioner is apprehending his arrest in connection with Gamharia P.S. Case No.29 of 2025 for the alleged offences registered under Sections 274, 275 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a) of Excise Act, pending in the Court of learned Chief Judicial Magistrate, Seraikella. 3. Learned counsel appearing for the petitioner submits that the petitioner has already complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Learned counsel appearing for the State submits that in light of the judgment of Hon’ble Supreme Court in the case of Satender Kumar Antil Versus Central Bureau of 2025:JHHC:22194 --2-- A.B.A. No. 4102 of 2025 Investigation & Anr., reported in (2022) 10 SCC 51 the petitioner is required to appear before the learned Court. 5. In view of the above, the petitioner is directed to surrender before the learned Court within two weeks and the learned Court will release the petitioner on the terms and conditions or the sureties as learned Court may deem fit and proper.
