GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 9022 OF 2025 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring that the inaction of the 3rd Respondent herein in disposing off the Appeal dt 02.12.2024 filed by the Petitioner herein against the confirmation order issued by the 2nd Respondent vide Notice No.11/1007/ TDR/ DC/ 2024 dated 02.11.2024 and the subsequent action of the 2nd Respondent herein in taking steps to bring down Under construction residential cum commercial building consisting of G plus 2 floors, cellar, stilt floors, RCC Roof Building situated in S.No.535-A, 530-A and 535 of Tadipatri Town at D.No/Plot No.7-2A, besides 7/1 of Navarang Talkies Road, Tadipatri, Anantapur Distric,t A.P, without awaiting the outcome of the Appeal dt 02.12.2024 pending before the 3rd Respondent as arbitrary, illegal, highhanded, contrary to the provisions of Andhra Pradesh Municipalities Act, 1965 contrary to the final order dt 14.11.2024 passed by this Hon’ble High Court in W.P.No.26049 of 2024 besides being violation of petitioners rights guaranteed under Art 14, 19(1)(g) and 300-A of the Constitution of India and pass such other orders....” 2. Heard learned counsel for the petitioner and learned Standing Counsel for the Respondents. 3. During hearing learned counsel for the petitioner would contend that this matter is squarely covered by an order of this Court, dated 07.04.2025 in W.P.No.8841 of 2025 and requested to pass similar order in this writ petition also. Learned Standing Counsel for the respondents conceded the same. 4. Considering the submissions of learned counsel, this Writ Petition is disposed of in terms of the order passed in W.P.No.8841 of 2025, dated 07.04.2025. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed. 5.
