The applicant has preferred this first bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he is arrested in connection with Crime No. 87/2022 registered at Police Station – Lalpur, District Mungeli, (C.G.) for the offence punishable under 2 Sections 420, 467, 468, 471, 120-B, 34 of the IPC. 4. Allegation against the present applicants is that he along with other co-accused persons tampered with the revenue records with intent to increase the area of land and shown the temple land as farmer’s land for selling paddy for Sewa Sahakari Samiti, village Suretha. Based on this, offence has been registered against the present applicant and other co- accused persons. 5. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. Learned counsel also submits that the similarly situated other co-accused persons have been granted bail by this Court in MCRC Nos.1384/2022, 9393/2022, 1789/2022, 1722/2022, 8059/2023, 1415/2024, 6114/2024 vide order dated 25.01.2023, 30.01.2023, 03.02.2023, 21.02.2023, 13.12.2023, 06.03.2024, 09.09.2024 respectively. He also submits that vide order dated 13.06.2024 passed in Criminal Case No.997/2022, all the co-accused persons have been acquitted by the Judicial Magistrate First Class, Lormi, District Mungeli. It has been also submitted that the present applicant is behind the bar since 04.02.2025, charge sheet has not been filed and there is no likelihood of the case being decided in near future. Therefore, the present applicant may also be extended privilege of regular bail on the same set of evidence. 6. Learned State counsel apposing the bail application submits that the present applicant is Patwari and he is the main accused in the case, therefore, his application may be rejected. 7. Considering the totality of the facts and circumstances of the case and further considering the orders dated 25.01.2023, 3 30.01.2023, 03.02.2023, 21.02.2023, 13.12.2023, 06.03.2024, 09.09.2024 passed in MCRC Nos.1384/2022, 9393/2022, 1789/2022, 1722/2022, 8059/2023, 1415/2024, 6114/2024, granting bail to other co-accused persons respectively, further considering that the applicant is in jail since 04.02.2025 and that the trial may take some time, without commenting anything on merit of the case, I am inclined to release the applicant on regular bail. 8. Accordingly, the instant bail application is allowed. 9. It is directed that the Applicant shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed.
