After arguing for a while upon pointed out by this Court that the petitioners have an appellate remedy available at their disposal against the impugned order passed by the Sub Divisional Magistrate, Ghagwal acting in his jurisdiction as Collector under J&K Land Revenue Act, Svt. 1996 why the writ petition is being resorted to, the learned counsel for the petitioners seeks the liberty of this Court to allow withdrawal of the writ petition with liberty granted to invoke the appellate remedy. 02. Dismissed as withdrawn with the liberty reserved in favour of the petitioners to approach the appellate authority under J&K Land Revenue Act, Svt. 1996 if they bear grievance against the impugned course of action. Serial No. 02 2 WP(C) No. 3340/2024 03. In case, the appeal comes to be preferred by the petitioners before the appellate authority within a period of next fifteen days from the date of passing of this order then there shall be no limitation involved in the matter of filing of the appeal by the petitioners before the appellate authority and the appeal be entertained without being tagged as time barred appeal.
