4. Heard Mr. Harshit Sanwal, learned counsel for the applicant, Mr. Vipul Painuly, learned Brief Holder and Mr. Mohd. Umar, learned counsel for the complainant.
5. As per the FIR the applicant, who is a priest, befriended the husband of complainant/victim and visited their home. It is alleged that on 02.10.2023 when the husband of the complainant/victim was not at home applicant came and after physically assaulting the complainant/victim, forcibly established physical relationship with her and allegedly made videos and photographs of the complainant/victim. It is also alleged in the FIR that on several occasions applicant established physical relationship with the complainant/victim.

Learned counsel for the applicant submits that applicant is a mature married lady and she is well capable to understand implications of her acts and
omissions. He submits that complainant/victim did not disclose that she was already married. He placed on record the statement of the husband of the complainant/victim, according to which, complainant/victim herself was in relationship with applicant and she never made any complaint to police regarding this fact. He further submits that applicant is languishing in jail since 17.11.2024 and he has no criminal history.

Learned counsel for the complainant submits that the act of the applicant is against the society. He further submits that the applicant is permanent resident of State of Uttar Pradesh and if applicant is released on bail there are chances of his absconding.
8. Having heard the learned counsel for the parties, on perusal of the record and without going into the merits of the case, this Court is of the view that applicant deserves bail.
9. Accordingly, bail application is allowed. Let the applicant-Devvrat Shukla be released on bail on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of court concerned.
