Neutral Citation No. - 2025:AHC-LKO:26388 Court No. - 18 Case :- WRIT - A No. - 5010 of 2025 Petitioner :- Pooja Goshwami Respondent :- State Of U.P. Thru. Secy. Bal Vikas Evam Pushtahar Lko. And 6 Others Counsel for Petitioner :- Sri Niwas Jaiswal,Vimal Kishor Singh Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for respondent Nos. 1 to 6. Notice to respondent no. 5 is dispensed with in view of the proposed order. The petition has been filed with the following main prayer:- (i) Issue a writ, order or direction in the nature of CERTIORARI thereby quashing the illegal appointment of the opp. Party No. 7 for the post of Aganbadi Karya Katri for center Manoharapur, Bal Vikas Pariyojana Ikauan, District Shravasti after summoning the same from the opp. parties. (ii) Issue a writ order or direction in the nature of MANDAMUS thereby commanding the Opp. parties No. 5&6 to consider the candidature of the petitioner for the post of Aganbadi Karya Katri for center Manoharapur, Bal Vikas Pariyojana Ikauan, District Shravasti according to the merit list.
Learned counsel for the petitioner submits that the petitioner is fully eligible for appointment to the post of Anganwari Karyakatri. However, the respondents, disregarding her merit, have arbitrarily appointed respondent no. 7. In response, the learned Standing Counsel, on the basis of written instructions, submits that under point IV, paragraph 11 of the Government Order dated 21.03.2023, it is mandatory to mention the eleven-digit number of the concerned Anganwari Centre in the application form. Failure to do so renders the application liable for rejection. It is stated that the petitioner
failed to mention this eleven-digit number in her application, and therefore her candidature could not be considered. On the other hand, respondent no. 7, Prem, secured higher merit under the BPL category and was accordingly called for physical verification. The selection has been made in compliance with the aforementioned Government Order. Perused the record as well as the Government Order dated
21.03.2023. As per the petitioner’s own case, she did not mention the eleven-digit number of the Anganwari Centre in her application. Hence, her candidature was not considered in accordance with the Government Order dated 21.03.2023. There appears to be no illegality in the selection process. The writ petition, being devoid of merit, is accordingly dismissed.
