We have gone through the report of the C.J.M., Gonda dated 19.04.2025, wherein it has been stated that the appellant- Ayodhya @ Madari s/o America died during the pendency of the appeal. The statements of the Sub-Inspector for the Police Station concerned, Gram Pradhan and Gram Panchayat Adhikari of Village- Belwa Bahuta Development Block Itiyathok and two family members have been enclosed to the certificate. Since the sole appellant has died, the appeal shall stands abated. However, the abatement order shall not mean that the trial court record be sent back. Since two connected appeals are pending, the trial court record shall be tagged with Criminal Appeal No.519 of 2005 and Criminal Appeal No.565 of 2005.
