Neutral Citation No. - 2025:AHC-LKO:26258 Court No. - 7 Case :- MATTERS UNDER ARTICLE 227 No. - 2641 of 2025 Petitioner :- Ram Dulare Yadav Respondent :- Settlement Officer (Cons.), Ayodhya And 10 Others Counsel for Petitioner :- Rajan Yadav,Gaurav Singh,Suraj Pandey Counsel for Respondent :- C.S.C. Hon'ble Saurabh Lavania,J. Heard learned counsel for the petitioner, learned Standing Counsel for the State/opposite party No.1 and perused the record. In view of order proposed to be passed, issuance of notice to the private- respondents is hereby dispensed with. By means of this petition, the petitioner seeks following main relief :- "Direct learned court below i.e. settlement officer District-Ayodhya to expedite and conclude the proceeding of Appeal Suit No. 819 of 2022, Rajendra versus Ram Dulare, in the interest of justice. Further direct, direct the court below not to grant repeated or casual adjournment to either party in suit, in the interest of justice." Considering the facts as indicated that the order dated 09.09.2022 under appeal is favourable to the petitioner and on account of the pendency of the appeal in issue which is pending since 28.09.2022 the petitioner is suffering hardship and mental agony, this Court is of the view that the indulgence of this Court is required. Learned Standing Counsel submits that he has no objection in case an expedite order is passed. Considering the facts and circumstances of the case, this petition is disposed of with a direction to the opposite party No.1/Settlement Officer (Consolidation) Ayodhya to decide the Appeal/Suit No.819 of 2022 (Rajendra versus Ram Dulare) most expeditiously after affording full opportunity of hearing to the parties to the litigation and without granting unnecessary adjournment to either party preferably, say within a period of two months from the next date fixed in the case, if there is no other legal impediment. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 6.5.2025 ML/- Digitally signed by :- MUNNA LAL High Court of Judicature at Allahabad, Lucknow Bench
