The petitioner is premature in its writ petition by its apprehension that the tender finalization committee or for that matter the respondent No. 2-Chief Engineer, PMGSY (JKRRDA), Jammu would entertain the financial bids of the non-eligible bidders who otherwise have qualified the technical bid stage but their documents are not fair and square. 02. It is for the respondent No. 2 or for that matter Contract Evaluation Committee, if there is any, to be best judge of the situation with respect to the eligibilities of the bidders participating in the financial bid as this Court is not meant for acting as a messenger for the petitioner for Serial No. 146 Supplementary List-1 2 WP(C) No. 3093/2025 registering reminder to the respondent No. 2 that due diligence is to be adopted for evaluating the financial bids. 03. The writ petition is, therefore, dismissed without prejudice to the rights of the petitioner to assail the outcome of the financial evaluation, in case, the petitioner loses out in that process.
