1. Heard Mr. D. K. Medhi learned counsel for the petitioner Ananda Murarka.
2. The petitioner has filed this application under Section 483 of the BNSS,
Page No.# 2/3 2023 with prayer for bail as he is behind bars since 23.05.2025 in connection with Helem Police Station Case No. 37/2025 corresponding to GR Case No. 96/2025 under Sections 64/69/68/351(3) of the BNS.
3. Heard Mr. P. Borthakur, learned Additional Public Prosecutor, Assam for the respondent State.
4. The allegation against the petitioner is that the victim was sexually assaulted by another person Deepak Murarka and when she raised alarm at the work place, everybody in the office came to her rescue and the present petitioner Ananda Murarka induced the victim to develop a relationship with him by promising the victim that he would marry her. Thereafter, a love relationship developed between the victim and the petitioner and the victim was induced to have physical relationship with the petitioner like husband and wife. The petitioner has applied vermilion on the victim on 21.11.2024 and the formal wedding date was fixed on 15.05.2025 and Juron was also observed on
04.05.2025. However, on the date of marriage, the petitioner did not turn up and thus the petitioner abandoned the victim and committed an offence of cheating.
5. I have scrutinized the Case Diary.
6. It appears that further custodial detention may not be required. The merits of this case are not brought to the fore. Investigation has also progressed substantially. It appears that bail may be granted to the petitioner.
7. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 50,000/- with a suitable surety of like amount to the satisfaction of the learned SDJM, Gohpur.
8. This application stands disposed of.
