According to him, respondent no. 2 has raised construction in violation of building byelaws of Mussoorie Dehradun Development Authority. By means of this writ petition, he has sought the following relief:- “(i) Issue a writ, order or direction in nature of mandamus directing respondent no. 1 to consider the written complaints of petitioner in regard to illegal constructions raised by respondent no. 2 and further to pass sealing and / or demolition order as per The Uttarakhand Urban and Country Planning and Development Act, 1973, after inspection of illegal constructions with prior notice to the petitioner.” 4. In view of the pleadings made and relief sought by petitioner, this Court thinks that ends of justice would be met, if petitioner is permitted to make representation. 2025:UHC:8630 5. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the Competent Authority in Mussoorie Dehradun Development Authority. If he makes representation within ten days from today, the Competent Authority shall consider the same and pass appropriate order, as per law, within four months thereafter. It goes without saying that respondent no. 2 and other stakeholders, if any, shall also be heard while taking any decision.
