Sr. No. 29 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU SWP No. 403/2016 Mudassir Ali and others …. Petitioner/Appellant(s) Through:- None V/s State of J&K and others …..Respondent(s) Through:- Ms. Jagmeet Kour, Advocate vice Mr. Raman Sharma, AAG CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDER 20.12.2025 1. The petitioners claim to have been engaged as Contractual Lecturers on different dates in different streams on academic arrangement on consolidated wages in various Government Higher Secondary Schools in the district Doda. Apprehending their ouster, they earlier approached this Court by way of SWP No. 3250/2014, in which an interim order was passed by this Court directing the respondents not to substitute the petitioners by similar arrangement, provided they were continuing on the date of passing of the order. The petitioners allege that the Chief Education Officer, Doda, issued fresh advertisements for making academic arrangements for the session 2016-2017 and, therefore, acted in violation of the interim directions passed by this Court. 2. This petition came up for consideration on 01.03.2016, when this Court, while issuing notice to the respondents for filing the objections, also SWP No. 403/2016 __ 2 of 2 directed maintenance of status quo with regard to the service of the petitioners. This direction is continuing ever since. 3. The respondents have filed their objections and have opposed the petition on multiple grounds. 4. It is submitted that the petitioners, having been appointed/engaged on academic arrangement, are not entitled to continue in such arrangement indefinitely and must make way for others. 5. Be that as it may, it is a fact that this petition has not been pursued by the petitioners diligently, in that, the petitioners have taken no steps to get this matter listed since the year 2016. Otherwise also, the final relief prayed for by the petitioners in this petition stands already granted at the interim stage and, therefore, the petitioners may have lost interest to pursue it. 6. In the given facts and circumstances, and having regard to the nature of controversy involved, this petition is disposed of by directing the respondents to allow the petitioners to continue and not to replace them by the similar arrangement, provided they are in academic arrangement as on date.
