Neutral Citation No. - 2025:AHC-LKO:28892 Court No. - 6 Case :- WRIT - C No. - 4377 of 2025 Petitioner :- M/S Mohd. Mudassir Thru. Prop. Mohd. Mudassir Ansari Respondent :- Asst. Director Employees State Insurance Corporation,Lko. And Another Counsel for Petitioner :- D.P. Dutt Tiwari, Chandra Mohan Counsel for Respondent :- Shishir Pradhan Hon'ble Pankaj Bhatia,J.
1. Heard the counsel for the parties.
2. The present petition has been filed by the petitioner challenging the order dated 07.02.2025, whereby the amount has been assessed and has been directed to be paid under section 45-C to 45-I of the Employees State Insurance Act,
1948.
3. The contention of the counsel for the petitioner is that while filling the details of the employees, the typographical errors had crept in while filling and uploading the forms and details of the employees. Subsequently, however the errors were noticed and a communication was addressed to the respondents to correct the said errors, however without correcting the said errors, the order dated 07.02.2025 has been passed.
4. The counsel for the respondents Sri Ran Vijay Singh states that after the reply was given by the petitioner, they were called along with the records for verification of the errors, as pointed out by them, however, as they did not approach, the order dated 07.02.2025 was passed.
5. Considering the submissions made at the bar, across the Bar the list of the employees as uploaded by the petitioner has been handed over, which prima- facie reveals that in the case of most of the employees, their names were filled either twice or thrice which prima-facie appear to be a human error.
6. Considering the fact that the human error has not been taken into
consideration, the order dated 07.02.2025 is set aside.
7. The petitioner is directed to appear before the respondent no.1 on 22.05.2025 at 12:00 Noon and point out the discrepancy in the forms uploaded. The respondent no.1 thereafter pass a afresh order taking into consideration the submission of the petitioner in accordance with law.
8. It is made clear that in case the petitioner does not appear on 22.05.2025, the benefit of this order shall come to an end.
9. The writ petition stands disposed off.
