This application has been filed for a direction to the opposite party nos. 2 to 4 to return the money to the applicant, which they had taken for arranging job and for a direction to the learned Civil Judge, (Senior Division) FTC, Faizabad to consider and decide the application of the petitioner dated 20.03.2025 within some stipulated time in accordance with law. The application dated 20.03.2025 has been filed by the applicant for taking the accused in custody and make inquiry from them and recover the money and the prayer made in the application is for a direction to the Police Station-Gosaiganj, District Lucknow to take the accused in custody. Admittedly the accuseds have been granted anticipatory bail by means of the order dated 18.09.2023 in Criminal Misc. Anticipatory Bail Application U/s 438 Cr.P.C. No. 2019 of 2023; Ranjan Kumar and others vs. State of U.P., Lucknow. In view of above, the prayer made before this Court as well as prayer for direction for disposal of the application moved by the applicant dated 20.03.2025 is wholly misconceived as once anticipatory bail has been granted by this Court, the accused cannot be directed to be arrested. The petition is misconceived. Dismissed accordingly.
