Lko And Another Counsel for Petitioner :- Tushar Bhushan Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for the respondents.
Learned counsel for the petitioner submits that the petitioner was engaged as a daily wager in April 1999 at Dudhwa Tiger Reserve, South Sonaripur Range, Pallia Kalan, Lakhimpur Kheri. Since then, he continuously discharged his duties until the year 2020, and from October 2020 onwards, he has been regularly performing his duties. It is further submitted that the petitioner has continuously rendered service in the department for the past 26 years without any break in service. Therefore, he is eligible for regularization on the post of Watcher in accordance with Rule 6 of the Uttar Pradesh Regularization of Persons Working on Daily Wages or on Work Charge or on Contract in Government Department on Group 'C' and Group 'D' Posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 2016.
Learned counsel for the petitioner prays that the petitioner's grievance would be adequately addressed if the respondent no. 2 is directed to decide his pending representation, annexed as Annexure No. 2 to the writ petition, within a fixed timeframe. Learned Standing Counsel has no objection to this innocuous prayer.
In view of the above, the petitioner is directed to submit a fresh representation to respondent no. 2 within two weeks from today. Upon receipt, respondent no. 2 shall consider and decide the said representation within a further period of four weeks by passing a reasoned and speaking order. Accordingly, the writ petition stands disposed of with the above observations.
