The present petition has been filed for the following main relief:- "I) issue a writ, order or direction in the nature of Mandamus commanding the Opposite Parties particularly Opposite Party No. 2 to 4 to restrain Opposite Party No. - 5 to 8 for construction in Land Gata No. 43 area 0.474 hectare situated Village Sarwa, Pargana Korauna, Tehsil Mishrikh, District Sitapur in pursuance of stay order dated 17.04.2025 passed by the Court of Opposite Party No. 2 (Annexure No. 1), in the interest of justice." On being confronted, taking note of the relief sought in the present petition, after taking note of the interim order dated 17.04.2025 passed by Additional Commissioner Judicial First, Lucknow Division, Lucknow, in Appeal No. 1320/2025 (Smt. Kaushaliya Versus Bachhulal and others) filed by the petitioner challenging the order dated 29.01.2025 passed by opposite party no.4 in partition suit no. 3528 of 2022, learned Counsel for the petitioner states that he does not want to press the present petition and the same may be dismissed as withdrawn with liberty to avail the remedy as available to him under law. To the aforesaid prayer, learned State Counsel has no objection. Accordingly, the present petition is dismissed as withdrawn with liberty as prayed for.
