(2) Additional District Magistrate, Udham Singh Nagar passed an order against petitioner on 3.7.2023. Petitioner challenged the said order as per provisions contained in Uttarakhand Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules before the Commissioner, Kumaon Division, Nainital. Petitioner’s appeal has been dismissed by Commissioner vide order dated 27.11.2024. Thus feeling aggrieved, petitioner has approached this Court. (3) Learned State Counsel, however, submits that under Rule 16 of the aforesaid Rules, petitioner has remedy of filing review before the State Government. The said submission is not disputed by learned Counsel for the petitioner. (4) Accordingly, writ petition is disposed of with liberty to the petitioner to approach the appropriate authority under Rule 16 of the aforesaid Rules.
