This is a petition filed by the petitioner seeking transfer of the suit filed by the respondent against her before the court of learned Munsiff Kupwara to the court of learned Munsiff Mendhar. 2. In the application, it has been submitted that the respondent has filed a civil suit against the petitioner seeking divorce which is pending before the court of learned Munsiff Kupwara. It has been further submitted that the petitioner is not in a position to travel to Kupwara from District Poonch where she is presently residing, so as to contest the suit. It has been further submitted that even the respondent is a resident of Tehsil Mendhar, District Poonch and, therefore, if the suit is transferred to Munsiff Mendhar, it will be more convenient and feasible for both the parties. Sr. No. 113 2 TrP (C) No. 25/2023 3. Mr. Ashish Sharma, learned counsel appearing for the respondent has entered appearance today has submitted that respondent has no objection if the suit is transferred to the court of learned Munsiff Mendhar. 4. Having regard to the concession made by learned counsel for the respondent coupled with the fact that both the parties are residing within the territorial jurisdiction of the District Poonch, it would be convenient for both of them to contest the suit in the court located in District Poonch. 5. Accordingly, the present petition is allowed and the suit titled “Mohd. Ali Azad Vs. Tasleem Akhter” [file No. 135/2023 with date of institution 08.02.2023] is withdrawn from the docket of the court of Munsiff Kupwara and is transferred to the court of Munsiff Mendhar. The Munsiff Kupwara shall forthwith transmit the original record of the suit to the court of Munsiff Mendhar. The parties are directed to appear before Munsiff Mendhar on 02.12.2025. 6. Disposed of. 7. Copies of this order be forwarded to Munsiff Kupwara and Munsiff Mendhar for information and compliance.
