Neutral Citation No. - 2025:AHC-LKO:26097 Court No. - 18 Case :- WRIT - A No. - 4948 of 2025 Petitioner :- Abhishek Gupta Respondent :- U.P. Subordinate Service Selection Commission Thru. Its Secy. And 2 Others Counsel for Petitioner :- Shubham Gupta,Ayush Sharma Counsel for Respondent :- Gaurav Mehrotra,C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for petitioner as well as Ms. Mariya Fatima, learned counsel for respondent no. 1 and 2 and learned Standing Counsel for respondent no. 3. By this petition, the petitioner has prayed for the following prayer:- (i) Issue a writ order or direction in the nature of mandamus commanding the opposite parties to appoint the petitioner on the post of Subordinate Agriculture Service Class 3 Technical Assistant Group C on the basis of reserve quota for dependents of Freedom Fighters, in the interest of justice. (ii) Issue any, order or direction in favour of the petitioner, as this Hon'ble Court may deem fit and proper in the circumstances of the case to meet the ends of justice. Learned counsel for respondents no. 1 and 2 has raised a preliminary objection. It is submitted that the writ petition has been filed after an inordinate delay of approximately four years. The result of the selection for the post of Subordinate Agriculture Service Class-3 Technical Assistant Group-C was declared on 19.06.2021, which is a matter of public record. However, this information was suppressed by the petitioner, and there is no explanation provided in the entire writ petition for the delay and latches in approaching the Court. Learned counsel for the petitioner has failed to give any plausible justification for the suppression of the publication of the result or for the delay in approaching this Court without any explanation. Accordingly, the writ petition is dismissed on the grounds of delay, latches, and suppression of material facts. Order Date :- 6.5.2025 R.C.
