Neutral Citation No. - 2025:AHC-LKO:26075 Court No. - 18 Case :- WRIT - A No. - 4886 of 2025 Petitioner :- Priyanka Yadav Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Seva Evam Pustahar Vibhag Lko. And 4 Others Counsel for Petitioner :- Ajay Sharma Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for the respondents. By this petition, the petitioner seeks for the following reliefs:- (i) Issue a writ, order, or direction in the nature of certiorari to quash the selection of Opposite Party No. 5/ Smt. Sarita, wife of Sri Rajesh, who has been selected by the selection committee for the post of Anganwadi Karyakarti at Anganbari Centre (Rural) in the Gram Panchayat Devgaon, Block-Dalmau, District-Rae Bareli, after summoning the original records related to the selection process, as the said selection suffers from legal infirmities, procedural irregularities, and arbitrariness. (ii) Issue a writ, order or direction in the nature of mandamus commanding the Opposite Party No. 3 and 4 to select /appoint the petitioner on the post of Anganwadi Karyakarty in pursuance to the Government Order dated 21.03.2023 at Anganwadi Center in the Gram Panchayat -Devgaon, Block Dalmau, District- Rae Bareli.
Learned counsel for the petitioner submits that respondent no. 5 has been selected and appointed to the post of Anganwadi Karyakatri on the basis of false income certificate obtained by misrepresenting facts. It is submitted that the husband of respondent no. 5 is employed as a lecturer in a privately aided college, her father-in-law is a retired army personnel receiving a pension, and her mother-in-law is also a pensioner. Learned Standing Counsel, on the basis of instructions, submits that an inquiry is ongoing regarding the petitioner's complaint. However, the petitioner's candidature has been rejected on the ground that the income certificate submitted by her was issued more than six months prior to the date of the advertisement.
This contravenes a mandatory condition specified in the advertisement and the Government Order dated 21.03.2023. Consequently, as the petitioner did not meet the requisite eligibility criteria, her candidature was rejected. With regard to the petitioner's complaint, since an inquiry is already underway by the State Government concerning her allegations, the opposite parties are directed to complete the inquiry within three months from the date of receipt of a certified copy of this order. The writ petition lacks merit and is accordingly dismissed.
