Neutral Citation No. - 2025:AHC-LKO:26019 Court No. - 18 Case :- WRIT - A No. - 4915 of 2025 Petitioner :- Smt. Sunita Devi Respondent :- State Of U.P. Thru. Addl. Chief Secy. Bal Vikas Seva Evam Pushtahar Govt. Of U.P. Lko. And 6 Others Counsel for Petitioner :- Arvind Kumar Kanaujea,Saksham Mishra,Syed Mohd Shahe Alam Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner as well as learned Standing Counsel for the respondents. Notice to respondent no. 2 is dispensed with in view of the proposed order. By this petition, the petitioner has prayed for the following reliefs:- (i) Issue a writ, order, or direction in the nature of certiorari quashing the impugned merit list/selection list dated 11.04.2025 issued by respondent no.5 by means of which the respondents have selected the respondent no.7 on the post of Angarnwari Karyakatri for Angarnwari Centre, Vishunpur Kharhara-4, Post Sadullah Nagar, Tehsil Utraula, District Balrampur, ignoring the candidature of the petitioner as contained in Annexure No. 1 to this writ petition. (ii) Issue a writ, order, or direction in the nature of mandamus commanding/directing the respondents to appoint/select the petitioner on the post of Anganwari Karyakatri for the Anganwari Centre, Vishunpur Kharhara-4, Post Sadullah Nagar, Tehsil Utraula, District Balrampur. Learned Standing Counsel, on the basis of written instructions, has submitted that the petitioner, Smt. Sunita Devi, did not submit her application under the EWS category while applying for the post of Anganwari Karyakatri. Consequently, her candidature was treated under the general category. It is further noted that the petitioner herself has mentioned this in her application form. In contrast, respondent no. 7 applied under the EWS category and therefore, was given priority and selected
accordingly. The instructions submitted by the learned Standing Counsel are taken on record. A perusal of the petitioner’s application form, available on record as Annexure No. 5, reveals that she applied under the general category and not the EWS category. Therefore, she is not entitled to the benefits available under the EWS category. The writ petition is devoid of merit and is accordingly dismissed. Order Date :- 5.5.2025 R.C.
