Sugarcane And Cane Industries U.P. Lko. And 2 Others Counsel for Petitioner :- Manish Jauhari,Ambuj Kumar Bajpai,Jameel Ahmad Counsel for Respondent :- C.S.C.,Puneet Chandra Hon'ble Rajesh Singh Chauhan,J.
1. Heard Sri Manish Jauhari, learned counsel for the petitioner, Sri Vijay Kumar, learned Standing Counsel for opposite party No.1 and Sri Puneet Chandra, learned counsel for opposite parties No. 2 & 3. 2. By means of this petition, petitioner has prayed for following reliefs:
"(i). Issue a writ order or direction in the nature of certiorari quashing the impugned order dated 21.06.2024 and order dated 02/06/2022 passed by Director, Lal Bahadur Shastri, Ganna Kisan Sansthan, U.P., Lucknow, and contained in Annexure No. 4 & 5 to the writ petition; (ii). Issue a writ order or direction in the nature of mandamus commanding the respondents to allow the petitioner to work on the post of librarian till permanent appointment by service commision."
3. At the very outset, Sri Puneet Chandra has raised objection regarding maintainability of the writ petition showing Annexure- 3, which is an order dated 10.09.2024 passed by this Court in Writ-A No.7630 of 2024, whereby the petition of the petitioner has been dismissed being withdrawn. 4. In the aforesaid writ petition, the order dated 21.06.2024 was assailed, whereas the same order has again been assailed so for the same relief subsequent petition may not be entertained. 5. The objection so raised by Sri Puneet Chandra is reasonable, therefore, the impugned order may not interfered in this writ petition. 6. Learned counsel for the petitioner has stated that the petitioner is willing to discharge her duties but on account of compelling circumstances which have been considered by this Court in the order dated 10.09.2024, the petitioner may not be
able to discharge her duties at transfer place i.e. Shahjahapur. Sri Jauhari has stated that the petitioner is having qualification to be appointed as librarian and the work of librarian was being taken from her at Lucknow itself, therefore, she may be accommodated at Lucknow so that she could discharge her duties and could look after her mother properly. 7.
On that Sri Puneet Chandra has stated that the post of librarian is filled up through direct recruitment by the Commission. 8. Be that as it may, since the impugned orders dated 21.06.2024 and 02.06.2022 have not been interfered by this Court therefore the petitioner may submit her joining at the transfer place i.e. Shahjahanpur within a week. After submitting her joining at transfer place i.e. Shahjahapur, she may prefer a representation to opposite party No.2 i.e. Director, Lal Bahadur Shastri Ganna Kisan Sansthan, Uttar Pradesh, taking all pleas and grounds which are available to her enclosing therewith the copies of all relevant documents including medical paper/prescription of the mother of the petitioner within a period of ten days and if such representation is preferred by the petitioner, the same may be considered and disposed of strictly in accordance with law, policy and sympathetically, preferably within a period of one month from the production of certified copy of the order of this Court and decision thereof shall be intimated to the petitioner. 9. The writ petition is disposed of, in view of the aforesaid terms. Order Date :- 8.5.2025 Reena/- (Rajesh Singh Chauhan,J.)
