Kalita, learned counsel for the petitioner. Also heard Mr. B. Sarma, learned Additional Public Prosecutor appearing for the State of Assam. This application has been filed under Section 483 of the BNSS, 2023 in respect of Satgaon P.S. Case No.85/2025 under Section 325 BNS, 2023 R/W Section 11(I) (d) of Prevention of Cruelty to Page No.# 2/2 Animal Act, 1960 and Section 13(1)/16 of Assam Cattle Prevention Act, 2021. On the day of the occurrence, 34 nos. of cows were carried by truck bearing registration No.AS01 PC 4470. The truck was stopped by police pursuant to the provision of law as laid down in Prevention of Cruelty to Animal Act, 1960 and Assam Cattle Prevention Act, 2021. Police found that one of the cows had already died. The petitioner was the helper of the truck. The driver of the truck was also arrested. The petitioner has already spent 41 days in judicial custody After considering the relevant circumstances relating to the case and after hearing the learned counsel for both sides, this Court has decided to agree with the petitioner. Accordingly, the bail application is allowed. The petitioner Yunus Ali, who was arrested in connection with Satgaon P.S. Case No.85/2025, shall be released on bail of Rs.25,000/- with surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup(M) Guwahati.
