Asha Bai W/o Premshankar @ Shankar, Aged About 37 Years, R/o Taleda, Police Station Taleda, District Bundi (Raj.). ----Petitioners Versus State Of Rajathan, Through PP ----Respondent For Petitioner(s) : Mr. Rajendra Singh Tanwar For Respondent(s) : Mr. Sudesh Saini, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 03/04/2025 1. Apprehending their arrest in connection with FIR No.06/2025 registered at Police Station Taleda, District Bundi for the offence(s) under Sections 189(2), 126(2), 115(2), 109(1) and 333 of BNS, the accused-petitioners have preferred this anticipatory bail application under Section 482 of BNSS. 2. Learned counsel for the accused-petitioners submits that accused-petitioners have falsely been implicated in this case. It is contended that the allegations against the petitioners are omnibus in nature and not specific. The case under Section 119(1) of BNS is not made out against the accused-petitioners. The injuries sustained to injured Pritam and Ram Prasad were not to be simple and grievous in nature, no injuries were found to be dangerous to life. The main dispute was between the complainant and his wife [2025:RJ-JP:15014] (2 of 3) [CRLMB-4541/2025] Sunita Bai. The age of the petitioner No.1 is 74 years and both the petitioners are women. Custodial investigation of accused- petitioners is not required and the accused-petitioners are ready and willing to cooperate with the investigation, therefore, anticipatory bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the anticipatory bail application. 4. Heard and perused the material available on record. 5. The co-accused Mohan Lal and Bheru Singh have already been enlarged on regular bail by this Court vide order dated 04.03.2025. The injuries sustained to injured Ram Prasad and Pritam were not opined to dangerous to life. The accused- petitioners are women and petitioner No.1 is aged about 74 years. Custodial investigation of the accused-petitioners is not required, therefore, considering the above facts, I deem it just and proper to allow the anticipatory bail application of the accused- petitioners. 6. Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioners namely: 1. Choti Bai W/o Mannalal, 2. Asha Bai W/o Premshankar @ Shankar, in connection with FIR No.06/2025 registered at Police Station Talera, District Bundi, they shall be released on bail, provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following [2025:RJ-JP:15014] (3 of 3) [CRLMB-4541/2025] conditions:- (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
