1. Heard learned counsel for the applicant and learned Standing Counsel.
2. This application under Section 12 of the Contempt of Courts Act has been filed alleging wilful disobedience of the
judgment and order dated 26.11.2024 passed on Writ-A No. 11198 of 2024.
3. Learned counsel for the applicant submits that the order of writ Court has not been complied with in letter and spirit. It is further submitted that the issue relating to the counting of work charge services is still pending before the Hon'ble Supreme Court and, therefore, the respondents have wrongly rejected the claim of the applicant. It is, thus, submitted that the respondent may be summoned and punished accordingly.
2. Shri Ramswaroop, learned Standing Counsel, on the other hand, submits that the writ Court directed the respondent to take decision on the representation of the applicant, which has already been taken. It is, thus, submitted that no contempt is made out.
3. Considering the submissions of the learned counsel for the applicant, learned Standing Counsel and going through the order of the writ Court as well as contents of the affidavit of compliance, it is evident that the decision on the representation of the applicant has already been taken by the respondent in pursuance of the order of writ Court. In view of above, this Court is of the view that no
contempt is made out.
4. The application, accordingly, stands dismissed.
5. However, it is always open to the applicant to ventilate his grievance, if any, before the appropriate forum.
