The Court made the following order:
1. The petitioner claims that she was granted DKT patta over an extent of Ac.4.15 cents in Sy.No.201-1 and an extent of Ac.0.85 cents in Sy.No.200-2 of Thirumalapuram Village, Yellanuru Mandal, Anantapuram District, vide DAR.Dis.No.4/1412, dated 06.09.2002. It is further case of the petitioner that, since the date of grant of patta, she is in peaceful possession and enjoyment of the subject lands and is eking out her livelihood by doing agricultural operations. While so, on 16.06.2020, the 4th respondent, along with his staff, came to the subject lands and started taking measurements. When the said highhanded action of the respondents was questioned by the petitioner, it was informed that the subject lands are required for allotment of house site pattas to the beneficiaries under the Navaratnalu-Pedalandariki Illu Scheme and the 4th respondent orally directed the petitioner to vacate, the present writ petition is filed. 2. This Court while ordering notice on 10.07.2020, granted an interim order, directing the respondents not to
dispossess the petitioner from the subject lands without following due process of law. 3. On the other hand, the 4th respondent-Tahsildar filed counter affidavit admitting the issuance of D-Form patta in favour of the petitioner over the subject lands. It is further averred in the counter affidavit that the lands assigned in favour of the petitioner were neither identified nor required for the purpose of allotting house sites. 4. In view of the categorical assertion made in the counter affidavit, this Court is inclined to dispose of the writ petition by directing the respondents not to interfere with the possession of the petitioner with respect to the land to an extent of Ac.4.15 cents in Sy.No.201-1 and an extent of Ac.0.85 cents in Sy.No.200-2 of Thirumalapuram Village, Yellanuru Mandal, Anantapuram District, except in accordance with law. 5. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
