The petitioner is apprehending his arrest in connection with Barhi (Padma) P.S. Case No.369 of 2024, for the alleged offences registered under Sections 126(2), 115(2), 109, 74, 75, 76, 78, 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned SDJM, Hazaribag. 3. Learned counsel appearing for the petitioner submits that the case diary has been called for by the earlier order which has been received. He further submits that at paragraph No.34 of the case diary it has come that so far this petitioner is concerned the case is not made out, however, in the said para it has been stated that the case is made out so far other accused persons are 2025:JHHC:30643 --2-- A.B.A. No. 4774 of 2025 concerned. He then submits that the altercation took place due to land dispute and both the sides are neighbour. 4. Learned counsel appearing for the State examining the case diary accepts the submission that in paragraph No.34 of case diary the petitioner has been exonerated. 5. In view of the above and considering paragraph No.34 of the case diary wherein it has come that the case against the petitioner is not found to be true, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned SDJM, Hazaribag in connection with Barhi (Padma) P.S.
