Neutral Citation No. - 2025:AHC-LKO:29101 Court No. - 18 Case :- WRIT - A No. - 4846 of 2025 Petitioner :- Mamta Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Bal Vikas Sewa Evm Pustahar Lko. And 5 Others Counsel for Petitioner :- Upendra Prakash Pathak Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. 1. Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the petitioner and Sri Ram Pratap Singh, learned Additional Chief Standing Counsel for the State- respondents. 3. Learned A.C.S.C., on the basis of written instructions which are taken on record, has submitted that the petitioner's income certificate could not be verified on the E-district portal and in absence of verified income certificate, petitioner's candidature has been considered in APL category by the selection committee in view of the Government Order dated 21.03.2023, paragraph 3 च (iii) however, respondent No.6 has been considered under BPL category on the basis of her income certificate. She has also been issued appointment letter as she has highest merit in the BPL category and has joined on the post in question. 4. Learned counsel for the petitioner submits that selection of respondent No.6 is vitiated as her income certificate has been wrongly given to her . 5. Perused the record. 6. Perusal of the record shows that no prayer in the writ petition has been made challenging the income certificate issued to respondent No.6. So far as the contention of learned counsel for the petitioner that her case has not been considered in BPL category, the same has been negated in view of the written instructions which are provided to the court. The candidature of the petitioner has considered under APL category and being a BPL category candidate, respondent No.6 has been given priority in terms of the Government Order dated 21.03.2023 and thus, there appears to be no illegality in the selection and accordingly, the petition being devoid of merits is dismissed.
