Neutral Citation No. - 2025:AHC-LKO:26586-DB Court No. - 2 Case :- WRIT - C No. - 4243 of 2025 Petitioner :- Dinesh Verma And Another Respondent :- Collector, Lucknow And 3 Others Counsel for Petitioner :- Mohammad Aslam Khan Counsel for Respondent :- C.S.C.,Alok Saxena Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard Sri M.A. Khan, learned Senior Advocate, assisted by Sri Mohammad Aslam Khan, Advocate for the petitioners, Sri Alok Saxena, learned counsel for the opp. party No. 4- State Bank of India, the learned Addl. C.S.C. for the State and perused the record. The petitioners claim to have paid back the entire loan amount, but they are aggrieved by the fact that an endorsement that 'they will not alienate the land/property in question etc.' continues in the Remarks column of the Khatauni in respect thereof pertaining to the land, which was mortgaged by the petitioners with the opp. party No. 4- Bank, however, the learned Standing Counsel says that the Remark column does not mention about the loan amount, therefore, it is not clear as to whether the endorsement relates to the loan amount or some other amount.
Learned counsel for the opp. party No. 4/State Bank of India says that as far as the loan is concerned, no dues are payable by the petitioners to the Bank/opp. party No. 4 and a certificate in this regard is already annexed as Annexure No. 10 to the writ petition. Be that as it may, as it is a matter of correction of record, therefore, appropriate proceedings for correction of record can be initiated by the petitioners as per law, specially as the order dated 06.01.2003 is not before us. If the petitioners do not have a copy of the said order, they can apply for it before the Collector/S.D.M., as the case may be. If an application, as aforesaid, is submitted, a copy of the said
order shall be provided to the petitioners to facilitate further action as per law. The Collector or the S.D.O., as the case may be, shall inform the petitioners on such application as to the basis of the said endorsement and if it is the order dated 06.01.2003, as
aforesaid, then provide a copy to him, within 3 weeks of submission of such application. With the above observations/directions this writ petition is
disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
