Bhandaria, District- Garhwa .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sanjay Kumar Pandey, Advocate For the State : Mr. Prabir Kumar Chatterjee, Spl. P.P. …...... 02/ 10.06.2025: Heard, learned counsel for the parties. 2. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 147, 148, 149, 341, 342, 323, 332, 307, 353, 354, 427, 504 and 506 of IPC and under Section 33(1)(c) of the Indian Forest Act. 3. The allegation against these petitioners is that they and others have constructed house over the forest land. The main allegation is that when the forest official had gone there, these petitioners and others have assaulted them. 4. Since there is an allegation of assault upon the Government Officials, I find that this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Bhandariya P.S. Case No.57 of 2024, pending in the court of learned Judicial Magistrate, 1st Class, Garhwa, stands rejected. R.S./ (ANANDA SEN, J.)
