Ms. Seema Sharma, Deputy Advocate General, for respondents No.2 and 3. OMP(M) No. 166 of 2025 Despite service none has appeared for private respondent No.1. No reply has been filed by the official respondents. By way of this application, a prayer has been made for condonation of delay of 30 days in filing the appeal under Section 37 of the Arbitration and Conciliation Act, 1996. Since, there is no rebuttal to the averments made in the application coupled with the fact that such contents are duly verified by an affidavit of the competent authority, there is nothing before this Court to disbelieve the said averments. I am satisfied that the applicant has been prevented by sufficient reasons from filing the appeal within the prescribed time of limitation. Accordingly, the application is allowed and the delay in filing the appeal is condoned. Arb. Appeal No. of 2025. Be registered. Admit. Issue post admission notice to the respondents. Ms. Seema Sharma, learned Deputy Advocate General waives service of notice on behalf of respondents No.2 and 3. Post admission notice be issued to respondent No.1, returnable on 8th October, 2025.
