A CHOUDHURY (INFORMANT),MR. AMIT GOYAL(INFORMANT) Page No.# 2/4 BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER 20.08.2025 1. Heard Mr. M.K Das, learned counsel for the petitioners and Mr. A.K. Goyal, learned counsel for the informant. Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor for the State. 2. On 06.06.2025, the petitioners were granted interim pre- arrest bail with the conditions. In this regard, the learned counsel for the petitioners submits that compliance with the same, they have cooperated with the investigation and appeared before the I.O and their statements were recorded. 3. It is submitted by the learned counsel for the petitioners that the case has emanated largely out of a civil dispute pertaining to a petrol pump and he has taken the Court through some of the relevant documents annexed by him in this regard. 4. The learned Additional Public Prosecutor for the State submits that the case diary has been received which reveals progress in the investigation; the statements of the petitioners have been recorded and the medical report with regard to the incident indicates simple injury cause by blunt force. 5. Mr. A.K. Goyal, learned counsel for informant objects to the grant of bail and points out that other FIR has also been lodged against these petitioners. Page No.# 3/4 6. The learned counsel for informant objecting to the bail has submitted that in the circumstances, because of the conduct of the petitioners, they may not be deserving of the grant of bail. 7. However, upon perusing the materials available at this stage and considering the submissions, prima-facie, it appears that the instant case has arisen in the backdrop of significant acrimony between the parties over running of petrol pump with allegations and counter allegations. One civil suit is also pending between the parties. One document allegedly extending the lease regarding the petrol pump is disputed by the informant’s side. 8. Nevertheless, I am of the considered view that seeing the progress of investigation and cooperation rendered by the petitioners, making the interim bail absolute would be in the interest of justice and it would also facilitate some resolution of their underlying disputes which prima-facie are civil in nature. 9. In such view of the matter, the interim bail granted vide order dated 06.06.2025 is hereby made absolute subject to the conditions - I) that the petitioners shall cooperate with process of law and shall not indulge in any illegal activities; II) that the petitioners shall not, in any manner, cause any harassment, harm or annoyance to the informant and his family members; Page No.# 4/4 III) that the petitioners shall not hamper or tamper with evidence; IV) that the petitioners shall intimate the I.O, if they are going outside the State of Assam 10.
