ORDER:
1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.59 of 2025 of J.R.Puram Police Station, Srikakulam District, registered for the offence punishable under Sections 316(3), 316(4), 305(a) of the Bharatiya Nyaya Sanhita, 2023.
3. The learned counsel for the petitioners submits that on account of the disputes in the employee and the employer relationship, the petitioner was arraigned as accused in the present complaint. The
learned counsel further submits that the offences alleged against the petitioners are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Considering the
submissions of the
learned counsel for the petitioner, the Station House Officer, J.R. Puram Police Station, Srikakulam District, is
directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in
i -3- CRLP. No.3614of 2025 S connection with Crime No.59 of
2025. This
order would not preclude the investigation officer to file charge sheet or final report after completion of the investigation.
5. Accordingly, the criminal petition is disposed off.
6. Miscellaneous petitions, if any, pending in the criminal petition shall SD/- M.RAMESH BABU stand closed.
