Present petition has been filed challenging the order dated 04.04.2025 passed by Civil Judge (Senior Division), Shrawasti. 2. Contention of learned counsel for the petitioners is that on the same pleadings earlier injunction was rejected as well as the appeal was dismissed. 3. Considering the fact that the order has been passed on an injunction application and an appeal is prescribed against the said order under Order 43 of CPC, present petition is disposed off permitting the petitioner to prefer an appeal, if so advised, in accordance with law. 4. The petitioner would be entitled to take all the grounds including the ground of res judicata when the appeal is preferred.
