Heard learned Counsel for the petitioner as well as learned Standing Counsel. 2. The present petition has been filed challenging an order dated 28.10.2024 whereby, the injunction was refused as well as the order dated 01.02.2025 whereby, the appeal was dismissed. 3. Both the courts below have recorded that the petitioner was not in occupation of the premises where the constructions are going on as is evident from the Commission report. Even in the suit in question, no relief for declaration has been served. 4. In view of the findings recorded, there is no reason to interfere with the impugned orders. The writ petition is dismissed.
