Neutral Citation No. - 2025:AHC-LKO:25504 Court No. - 18 Case :- WRIT - A No. - 4832 of 2025 Petitioner :- Prem Chandra Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Estate Lko And Another Counsel for Petitioner :- Mahendra Nath Yadav Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 and 2. By this petition, the petitioner has prayed for the following relief:- "(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite party no-2 to provide the benefits of 2nd ACP, 3rd ACP as per the government order dated 5.11.2014, 3.3.2015 and 18.6.2024 since 1.12.2008 and 9.11.2013 respectively like the junior employee Chandra Bhavan Yadav has received by order dated 27.12.2016 and thereafter on the basis of last pay drawn the pension and gratuity as has been given to the junior employee Chandra Bhavan Yadav may be directed to be paid by the respondent no- 2. (ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite party no- 2 to consider and decide the representations dated 2.3.2023, 6.12.2023, 8.5.2024, 19.9.2024 and lastly on 20.3.2025 (Annexure No:1, 2, 3 and 17) submitted by the petitioner for the benefits of 2nd ACP, 3rd ACP and then on the basis of determining the last pay drawn the pension and gratuity may be directed to be paid by the respondent no-2 accordingly." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner may be directed to be decided by respondent no.2. Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.2 i.e. Director, Estate Directorate, Jawahar Bhawan, Lucknow within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.2 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
